1. Introduction
Welcome to SignalPulseOrbit ("we," "our," or "us"). These Terms & Conditions ("Terms") are the rules and regulations governing your engagement with our yacht charter services and the website located at signalpulseorbit.sbs (the "Service"), which is provided by SignalPulseOrbit.
By reserving a yacht or by using the Service, you consent to the stipulations outlined in these Terms. Should you not agree with any section of these terms, you are prohibited from accessing the Service.
2. Service Overview
SignalPulseOrbit offers high-end yacht charter experiences, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate trips
- Private celebrations
- Several day charters
Service provision relies on yacht availability and weather conditions. We hold the authority to alter or discontinue any service without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, participants must:
- Have reached a minimum age of 18 years
- Submit accurate and full information
- Complete payment for the deposit as outlined in the reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Reservation confirmation is secured only after we acknowledge payment and provide you with written confirmation. We may refuse service to any individual at our discretion.
3.3 Availability
Reservation of yachts is contingent upon the availability of vessels and favorable weather conditions. We strive to fulfill your requested dates and times with reasonable effort.
4. Payment Terms
4.1 Pricing
All listed prices are expressed in € and include all relevant taxes unless stated otherwise. We may revise our prices without prior notice.
4.2 Payment Schedule
- A deposit which amounts to 50% of the full cost of the charter is required at the time of booking
- The remaining balance needs to be settled 48 hours prior to the yacht’s scheduled departure
- Any additional costs incurred (if any) are to be paid at the end of the charter
4.3 Payment Methods
We accept prominent credit cards, wire transfers, and certified checks. All payments are processed via secured, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With at least 72 hours' notice before departure: Refund provided, less any transaction fees
- Between 24-72 hours before departure: 50% refund
- Within 24 hours of departure: No refund will be granted
5.2 Weather Cancellations
Should weather conditions be deemed unsafe for sailing by our captain, we will propose to either:
- Reschedule the charter to an alternate date at no additional cost
- Issue a full refund if rescheduling proves unfeasible
5.3 Mechanical Issues
If the designated yacht encounters mechanical issues, we will strive to offer an appropriate substitute. Should no replacement be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions provided by the crew
- Utilize the safety gear provided when necessitated
- Inform us of any health conditions that might influence their safety
- Stay within designated sections of the yacht
6.2 Prohibited Items
The items not permitted on the yacht include:
- Glass containers
- Forbidden substances
- Firearms or other weapons
- Excessive quantities of drinks beyond reasonable consumption
- Pets (except when given prior authorization)
6.3 Conduct
Travelers are expected to behave in a courteous and respectful manner. Should a passenger’s conduct pose a threat to safety or disrupt the experience for others, we have the right to cease the charter prematurely and without a refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the amount paid for the yacht charter. We are not responsible for:
- Injuries that arise due to the negligence of passengers
- Theft or damage of personal property
- Indirect losses, consequential harm, or punitive damages
- Delays prompted by weather or situations not under our control
7.2 Insurance Coverage
We uphold comprehensive insurance covering our fleet and operational activities. Clients are accountable for ensuring their individual travel and personal insurance coverage.
7.3 Assumption of Risk
By taking part in our yacht charters, participants recognize the innate risks linked with maritime activities, accepting personal responsibility for their safety and well-being.
8. Modifications and Itinerary Changes
We hold the authority to alter travel routes, schedules, or itineraries due to weather circumstances, safety needs, or operational demands. We will endeavor to provide a suitable substitute experience whenever feasible.
9. Force Majeure
We are exempt from accountability for delays, cancellations, or alterations resulting from factors beyond our control, which encompasses, but is not limited to:
- Intense weather scenarios
- Natural catastrophes
- Regulatory directives
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
Your personal data is managed in accordance with our Privacy Policy. By engaging with our services, you grant consent for the collection and use of your data as outlined in said Privacy Policy.
11. Intellectual Property
The content present on our website, such as text, visuals, trademarks, and imagery, is protected under copyright and trademark laws. Reproduction, distribution, or creation of derivative works are prohibited without our express written consent.
12. Governing Law
These Terms are subject to the laws in force within Monaco. All disputes will be settled through the jurisdiction of the courts situated in Monte Carlo, Monaco.
13. Changes to Terms
We reserve the right to make changes to these Terms as needed. Any amendments will be noted on our website with the date of revision clearly indicated. Your sustained use of our service means you accept the altered Terms.
